Law 37/2007 of 16 November, on the reuse of public sector information, which transposes Directive 2003/98/EC of the European Parliament and of the Council, regulates the reuse of public information held by administrations and organisations in which they have a majority participation. In essence, it establishes the right of all potential market actors to reuse information from public bodies. In accordance with this regulation, the Administration allows the reproduction, distribution and public communication of the work, as well as the transformation of the work to create derivative works, provided it does not contradict any licence or notice that the work may have, which takes precedence.
To reuse the information, the following conditions must be met:
• a) Do not distort the meaning of the information.
• b) Always cite the source of the information.
• c) Mention the date of the last update of the information.
Likewise, reuse may be limited by the protection of other priority legal interests, such as the protection of personal data, privacy or the intellectual property rights of third parties. The reuse of works protected by intellectual property rights can be formalised through the use of open distribution licences, such as those of Creative Commons, which grant certain exploitation rights over the works. In content where this type of licence is applied, reuse is permitted under the conditions established therein.
The use of logos, brands, coats of arms and distinctive symbols of the Camí dels Bons Homes Regulatory Council is not authorised in any case in publications and websites that are not owned, in whole or in part, or sponsored by this institution. These corporate graphic identity elements are the exclusive property of the Camí dels Bons Homes Regulatory Council and are protected by current applicable legislation.
